Design & Consultation Policy
Effective 8 October 2026. These general website policies are subject to the accepted project contract and non-excludable Australian consumer and NSW building law rights. They are not a substitute for a legally compliant residential building contract.
Enquiries and site visits
Submitting the online form does not create a contract or guarantee a site visit. Garden Art will confirm whether an initial discussion, on-site consultation, measurement or design service is available and whether a fee applies before it is booked.
Fees and deliverables
Any consultation or design fee, payment timing, included drawings, planting schedules, revisions and delivery dates must be agreed in writing before paid work begins. Do not assume that a preliminary discussion includes a detailed design.
Revisions and changes
The accepted proposal defines included revisions. Additional revisions or changes to the brief may require a written fee and timeframe adjustment before work proceeds.
Design ownership and permitted use
Unless agreed otherwise, Garden Art retains copyright in its original drawings and concepts. The client receives the licence expressly specified in the written design agreement, subject to applicable law.
Accuracy and approvals
Concepts may be illustrative rather than construction-ready. Site measurements, approvals, engineering and permits will be allocated in the contract. Garden Art will use due care and skill and comply with applicable consumer guarantees.
Cancellation
Cancellation of design work is governed by the agreed design contract, statutory cancellation rights and reasonable legally recoverable costs, not automatic forfeiture of fees.
